By using the InGameNow.com web site, a service of sfEntrepreneurs, Inc., you agree to be bound by the following terms and conditions ("Terms of Use").
Basic Terms
1. You must be 13 years or older.
2. You are responsible for all activity that occurs under your screen name.
3. You are responsible for keeping your password secure.
4. You are responsible for your conduct and any data, text, screen names, profiles, links ("Content") that you submit, post, and display on the InGameNow.com service.
5. You may not abuse, harass, threaten, impersonate or intimidate other InGameNow users.
6. You may not use the InGameNow.com service for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.
7. You may not, in the use of InGameNow, violate any laws in your jurisdiction (including but not limited to copyright laws).
8. You may not modify, adapt or hack InGameNow.com or modify another website so as to falsely imply that it is associated with InGameNow.com.
9. You may not transmit any worms or viruses or any code of a destructive nature.
10. You may not create or submit unwanted email to any InGameNow members ("Spam"). Violation of any of these agreements will result in the termination of your InGameNow.com account. While InGameNow prohibits such conduct and content on its site, you understand and agree that InGameNow cannot be responsible for the Content posted on its web site and you nonetheless may be exposed to such materials and that you use the InGameNow.com service at your own risk.
General Conditions
1. We reserve the right to modify or terminate the InGameNow.com service for any reason, without notice at any time.
2. We reserve the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify you via internet mail according to the preference expressed on your account. What constitutes a "material change" will be determined at our sole discretion, in good faith and using common sense and reasonable judgment.
3. We reserve the right to refuse service to anyone for any reason at any time.
4. We may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use.
5. The InGameNow service makes it possible to post Content hosted on InGameNow to outside websites. Pages on other websites which display data hosted on InGameNow.com must provide a link back to InGameNow.
6. We reserve the right to reclaim usernames on behalf of businesses or individuals that hold legal claim or trademark on those usernames.
DMCA
Digital Millennium Copyright Act Compliance. It is InGameNow's policy to respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act. If you are a copyright owner or an agent thereof, and you believe that any content hosted on InGameNow infringes your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing InGameNow's Designated Copyright Agent with the following information in writing:
i. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
ii. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works on InGameNow are covered by a single notification, a representative list of such works at InGameNow;
iii. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit InGameNow to locate the material;
iv. Information reasonably sufficient to permit InGameNow to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted;
v. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law (for example, "I am under the good faith belief that the use of the copyrighted content that is identified herein is not authorized by the copyright owner, its agent, or the law."); and
vi. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed (for example, "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or authorized to act on behalf of the copyright owner, of the copyright(s) that is allegedly infringed by the aforementioned content.").
InGameNow's Designated Copyright Agent to receive notifications of claimed infringement can be reached as follows: Through the contact us form. You acknowledge that if you fail to comply with all of the requirements of this section, your DMCA notice may not be valid.
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.
